Terms of Service

Terms governing use of our website and services.

1. Agreement to Terms

By accessing or using the Nova Solutions Property Management website (novaspm.com), tenant portal, owner portal, or any of our related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services.

2. Description of Services

Nova Solutions Property Management provides residential property management services across Nova Scotia, including but not limited to:

  • Tenant placement and screening
  • Rent collection via Pre-Authorized Debit (PAD) and other methods
  • Property maintenance coordination
  • Property inspections and reporting
  • Owner financial reporting and disbursements
  • Nova Scotia Residential Tenancies Act (RTA) compliance

Specific services are governed by individual property management agreements between Nova Solutions and property owners.

3. User Accounts

Certain features of our Services require you to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Pre-Authorized Debit (PAD) Terms

If you enroll in our Pre-Authorized Debit program for rent payments, the following terms apply:

  • PAD enrollment requires your explicit consent and valid banking information
  • Debits are processed on the schedule specified in your PAD agreement (typically the 1st of each month)
  • You may cancel your PAD enrollment by providing 30 days written notice
  • You have the right to receive reimbursement for any PAD that is not authorized or is inconsistent with the terms of your PAD agreement, subject to Payments Canada rules
  • Payment processing is handled securely through Stripe in compliance with PCI DSS standards

5. Acceptable Use

You agree not to use our Services to:

  • Violate any applicable law, regulation, or third-party rights
  • Submit false, misleading, or fraudulent information (including on rental applications)
  • Interfere with or disrupt the operation of our Services or servers
  • Attempt to gain unauthorized access to any part of the Services or other users' accounts
  • Use automated systems (bots, scrapers) to access the Services without our written permission

6. Intellectual Property

All content on the Nova Solutions website and portals, including text, graphics, logos, images, and software, is the property of Nova Solutions Property Management or its licensors and is protected by Canadian copyright and intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without prior written consent.

7. Rental Listings

Rental listings on our website are provided for informational purposes. While we make every effort to ensure accuracy, availability and pricing are subject to change without notice. A listing does not constitute an offer to lease, and all tenancies are subject to our standard application and screening process.

8. Limitation of Liability

To the fullest extent permitted by law, Nova Solutions Property Management shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use our Services. Our total liability for any claim arising from these Terms shall not exceed the total fees paid by you to Nova Solutions in the twelve (12) months preceding the claim.

9. Disclaimer of Warranties

Our Services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Services will be uninterrupted, error-free, or free of harmful components. Property management services are provided in accordance with individual management agreements.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Nova Scotia and the federal laws of Canada applicable therein. Any disputes arising from these Terms shall be resolved in the courts of Nova Scotia. Tenancy-related disputes are subject to the jurisdiction of the Nova Scotia Residential Tenancies Program.

11. Termination

We reserve the right to suspend or terminate your access to our Services at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Services ceases immediately. Provisions that by their nature should survive termination will remain in effect.

12. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Your continued use of the Services after any changes constitutes acceptance of the revised Terms.
